Applicants who hold a Bridging Visa A, having already applied for a subclass 485 visa, may wish to apply for a subclass 457.
If it has been more than 28 days since an applicant has held a substantive visa, the matter of obtaining a Schedule 3 waiver arises.
The purpose of Schedule 3 is to encourage non-citizens who have a legitimate basis for remaining in Australia to apply for a further visa while discouraging and preventing non-citizens from benefiting by remaining in Australia unlawfully by acquiring a visa while remaining here without lawful permission.
The Department will consider such requests for a waiver on a case by case basis, focusing on the factors and criteria in PAM Schedule 3.
