Visa Application Charge – second instalment
Vocational English
Australian and New Zealand Standard Classification of Occupations (second edition) published by the Australian Bureau of Statistics.
An organisation that is either controlled by, operates wholly or to a significant extent for the benefit of one or more other organisations.
An Australian citizen or permanent resident.

Achieved a score of at least 6 in each of the four test components (speaking, reading, listening and writing) in an International English Language Testing System (IELTS) test that has been undertaken in the three years immediately prior to lodging the visa application.
Achieved a score of at least 'B' in each of the four test components of an Occupational English Test (OET) that has been undertaken in the three years immediately prior to lodging the visa application.
Achieved the following minimum test scores in each of the four test components: 24 for listening , 24 for reading, 27 for writing and 23 for speaking, in a Test of English as a Foreign Language internet-based test (TOEFL iBT) test that has been undertaken in the three years immediately prior to lodging the visa application.
Achieved a test score of at least 65 in each of the four test components (speaking, reading, listening and writing) in a Pearson Test of English (PTE) Academic that has been undertaken in the three years immediately prior to lodging the visa application.
Achieved a test score of at least 185 in each of the four test components (speaking, reading, listening and writing) in a Cambridge English: Advanced (CAE) test that has been undertaken on or after 1 January 2015 and prior to lodging the visa application.
An application that provides all information necessary for processing, including evidence of completed health and character checks (if applicable) and other necessary documents.
The Consolidated Sponsored Occupation List (CSOL) is a list of eligible occupations for positions nominated under the Direct Entry stream of the Employer Nomination Scheme (ENS).This list available on the department’s website CSOL
A person is in a de facto relationship with another person if:
• they are not in a married relationship (for the purposes of the Migration Act 1958) with each other;
• they are not related by family;
• they have a mutual commitment to a shared life to the exclusion of all others;
• the relationship between them is genuine and continuing;
• they live together or do not live separately and apart on a permanent basis; and
• the relationship has continued for the period of 12 months immediately preceding the date of application.
Note: The 12 month relationship requirement at time of application lodgement does not apply if you can establish that there are compelling and compassionate circumstances for the grant of the visa.
Legally married.
A dependent child is the child or step-child of the family head, their spouse or de facto partner where the family head, their spouse or de facto partner has legal responsibility for the child.
Dependent children (aged 18 years and over) and other dependent relatives of the family head or their spouse or de facto partner may be considered in the application if:
• they have never married or been in a de facto relationship, are widowed, divorced or separated
• they are usually resident in the primary person’s household.
• they rely on the primary person for financial support for their basic needs
• the primary person has supported them for a substantial period
• they rely on the primary person more than any other person or source.
The Direct Entry stream is for ENS or RSMS applicants who are untested in the Australian labour market and have not held a subclass 457 visa for at least 2 years or who are applying directly from outside of Australia.
An eligible investment that is owned by the person for the purpose of producing a return by way of income or capital gain and is not held for personal use is one of the following:
• an ownership interest in a business
• a loan to a business
• cash on deposit
• stocks and bonds
• real estate
• gold or silver bullion.
An eligible New Zealand citizen is a person who at the time of last entry to Australia would have met health and character checks and:
• held a Special Category (subclass 444) visa on 26 February 2001; or
• held a Special Category (subclass 444) visa that was in force for at least one year in the 2 years before 26 February 2001; or
• has a certificate, issued under the Social Security Act 1991, that states the citizen, for the purposes of the Social Security Act 1991, was residing in Australia on a particular date (note that Centrelink stopped accepting applications for these certificates in February 2004).
The Employer Nomination Scheme is a permanent employer sponsored visa program which allows Australian employers to sponsor foreign skilled workers to fill vacancies in their business.
You may need to sit an English language test that is approved by the Department. For more information on test scores and testing centres, please visit the DIBP website.
Documents in languages other than English must be accompanied by an English translation.
• In Australia completed by a translator accredited by the National Accreditation Authority for Translators and Interpreters (NAATI). You should ask at your nearest office of the department for further information about how to get your documents translated.
• If you are applying outside Australia, your nearest Australian mission can provide further information on how to get your documents translated.
An EOI is not a visa application, it is an online form which allows an intending migrant to express interest in applying for a skilled visa. An intending migrant can only lodge a points tested skilled or business innovation and investment visa application once they have submitted a complete EOI and have subsequently received an invitation from the Minister for DIBP to apply for a visa. Intending migrants can also express interest in the employer sponsored visa programs and be found and contacted by an employer to discuss employment and sponsorship opportunities.
In relation to a business or investment, fiscal year means:
•If there is applicable to the business or investment by law an accounting period of 12 months - that period
or
•in any other case - a period of 12 months approved by the Minister in writing for that business or investment.
If you have functional English you:
- can read and understand English texts about familiar topics;
- write English well enough to communicate ideas or information for a variety of purposes but make some errors;
- understand spoken English about familiar topics; and
- you speak English well enough to handle everyday communication adequately, despite some errors.
- If you or members of your family aged over 18 years who are included in your application have less than functional English and require English tuition, you may be liable to pay the second instalment of the Visa Application Charge.

You may be regarded as having functional English if you provide evidence of the following:
You are the holder of a valid passport issued by the United Kingdom, the United States of America, Canada, New Zealand, or the Republic of Ireland and you are a citizen of that country.
An International English Language Testing System (IELTS) test result of an average band score of at least 4.5 based on the four test components of speaking, reading, listening and writing. Your test must have been completed within 12 months of visa application lodgement or can be completed during visa application processing.
A Test of English as a Foreign Language internet-based Test (TOEFL iBT) test result of a total band score of at least 32 based on the four test components of speaking, reading, writing and listening. Your test must have been completed within 12 months of visa application lodgement or can be completed during visa application processing.
A Pearson Test of English (PTE) Academic test result of an overall band score of at least 30 based on the four test components of speaking, reading, writing and listening. Your test must have been completed within 12 months of visa application lodgement or can be completed during visa application processing.
A Cambridge English: Advanced (CAE) test result of an overall band score of at least 147 based on the four test components of speaking, reading, writing and listening and the test must have been taken on or after 1 January 2015. Your test must have been completed within 12 months of visa application lodgement or can be completed during visa application processing.
A positive assessment by an Adult Migrant English Program service provider in Australia that you have functional English.
Completed all years of primary education and at least three years of secondary education in an educational institution in or outside Australia and all instructions were in English.
Completed at least five years of secondary education in an institution in or outside Australia and all instructions were in English.
Successfully completed at least one year of full-time study or equivalent part-time study towards a degree, higher degree, diploma, or associate diploma in an institution in Australia and all instructions were in English.
Completed a degree, a higher degree, a diploma or a trade certificate that required at least two years of full-time study or training in an institution in or outside Australia and all instructions were in English.
The functional level of the Australian Assessment of Communicative English Skills (ACCESS) test certified by the relevant testing body. Your test must have been completed within 12 months of visa application lodgement or can be completed during visa application processing.
Your partner and dependent children.
A labour agreement is a formal agreement between an Australian employer and the Australian government which allows for the recruitment of a specified number of skilled workers from overseas in response to identified skills shortages in the Australian labour market.
A non-citizen who holds a valid visa.
A married relationship or de facto relationship that has continued for 3 years or more, or 2 years or more if there is a dependent child of the relationship.
A business is a main business in relation to the applicant if all of the following exist:
• the applicant has, or has had, an ownership in the business
• the applicant maintains, or has maintained, direct and continuous involvement in management of the business from day-to-day and in making decisions affecting the overall direction and performance of the business
• the value of the applicant's ownership interest, or the total value of the ownership interests of the applicant and the applicant's spouse or de facto partner, in the business is or was at least:
- 51 per cent of the business where the turnover is less than AUD400 000 per annum
- 30 per cent of the business where the turnover is AUD400 000 or more per annum
- 10 per cent where the business is a publicly listed company
• the business is a qualifying business.
For the purposes of a subclass 457 visa application, a person is a member of the family unit of the family head if the person is any of the following:
• a spouse or de facto partner of the family head
• a dependent child of the family head or of a spouse or de facto partner of the family head
• a dependent child of a dependent child of the family head or of a spouse or de facto partner of the family head
• a dependent relative of the family head or of a spouse or de facto partner of the family head
• a non-dependent child of the family head or of a spouse or de facto partner of the family head — see ‘Child (other)’.
• they are married to each other under a marriage that is valid for the purposes of the Migration Act 1958;
• they have a mutual commitment to a shared life as husband and wife to the exclusion of all others;
• the relationship between them is genuine and continuing; and
• they live together or do not live separately and apart on a permanent basis.
The net assets of a business is the amount attributable to the owners or shareholders of the business after deducting financial claims upon the business by third parties from total assets ( Net assets = total assets / liabilities).
An employer nomination made online via the e-lodgement facility for a position within the employer’s business
The employer who is seeking to nominate a foreign skilled worker to fill a skilled vacancy in their business
The person who has been nominated by the nominator to fill the position
The occupation ceiling is a limit on how many people could be invited to apply for a skilled visa from a particular occupation group under the SkillSelect. Its purpose is to prevent the skilled migration program being dominated by a small number of occupations. Once the limit is reached for each program year, there would be no further invitations to apply for migration from that particular occupation group.
A business not operating in Australia.
Companies who seek to recruit overseas workers to hire out to unrelated businesses.
In relation to a business, means an interest in the business as one of the following:
•a shareholder in a company that carries on the business
•a partner in a partnership that carries on the business
•the sole proprietor of the business including such an interest held indirectly through one or more interposed companies, partnerships or trusts.
A married or de facto partner or spouse
This is the minimum number of points you must score to pass the points test for certain visa types. You must indicate that you reach the pass mark before you can be selected by SkillSelect for an invitation to apply for a visa with a pass mark.
Permanent visa holders are able to enter, live and work in Australia indefinitely. After a specified period they can apply for Australian Citizenship.
Public Interest Criterion Fraud was introduced by DIBP on 2 April 2011 to minimise the degree to which applicants submit fraudulent, false or misleading information. PIC Fraud applies to a suite of Skilled, Business Skills and Student visas. The fraud assessment compromises of three primary questions:
1.Have you provided bogus documents or information that is false or misleading during the course of the current application?
2.Have you previously provided bogus documents or information that is false or misleading in relation to a visa that you held in the 12 months before current application was made?
3.Have you had a visa refused for failing to meet the Fraud PIC in the three year period immediately before both time of application and decision?
If you are found to have supplied bogus documents or provided information that is false or misleading to DIBP your application will be refused and you (and all migrating family members included in your application) will be subject to a three year bar which may prevent the grant of a further visa that is subject to assessment under the Fraud PIC.

The primary sponsored person is the overseas skilled worker who is being nominated to work temporarily in a nominated occupation in Australia.
To demonstrate proficient English you must provide evidence of one of the following:
You have achieved a score of at least 7 in each of the four test components (speaking, reading, listening and writing) in an International English Language Testing System (IELTS) test that has been undertaken in the three years immediately prior to lodging the visa application.
You have achieved a score of at least 'B' in each of the four test components of an Occupational English Test (OET) that has been undertaken in the three years immediately prior to lodging the visa application.
You have achieved the following minimum test scores in each of the four test components: 24 for listening , 24 for reading, 27 for writing and 23 for speaking, in a Test of English as a Foreign Language internet-based test (TOEFL iBT) test that has been undertaken in the three years immediately prior to lodging the visa application.

A temporary visa allowing a person to enter and remain in Australia until a decision is made on the permanent visa application.
Is an enterprise that:
•is operated for the purpose of making a profit through the provision of goods, services or goods and services (other than the provision of rental property) to the public
•is not operated primarily or substantially for the purpose of speculative or passive investment.
A regional migration agreement (RMA) is an agreement between the Australian Government and a regional representative, for example the relevant state or local government, council or other local organisation. The RMA will act as an overarching arrangement under which employers will sign individual labour agreements. This will ensure that the employers are responsible for sponsorship obligations.
The Regional Sponsored Migration Scheme is a permanent employer sponsored visa which allows Australian employers in regional, remote or low population growth areas of Australia to sponsor foreign skilled workers to fill vacancies in their business.
A secondary sponsored person is someone who is included in the nomination by the sponsor for the primary sponsored person on the basis of being a member of the primary sponsored person’s family unit. A secondary sponsored person is often also a secondary visa applicant.
A secondary visa applicant is a person who is seeking to meet the secondary requirements for the grant of a visa on the basis of being a member of the primary visa applicant’s family unit.
A Skills Assessment is an assessment of an intending migrant’s skills and qualifications which is undertaken by a recognised assessing authority. A skills assessment needs to be completed in order to submit a complete EOI accurately reflecting the intending migrant’s nominated occupation. A full list of recognised assessing authorities can be located on the department’s website.
The Skilled Occupation List (SOL) is a list of approved occupations that are available for permanent and temporary skilled migration to Australia. An occupation must be nominated by the intending migrant to facilitate a complete EOI submission. Detailed information can be found on the department’s website.
A person is the spouse of another person if they are in a married relationship.
For some visa categories you must be sponsored.
An Australian or overseas business that has been approved as a standard business sponsor.
A substantive visa means a visa other than:
• A bridging visa; or
• A criminal justice visa; or
• An enforcement visa.
To demonstrate superior English, you must provide evidence of one of the following:
You have achieved a score of at least 8 in each of the four test components (speaking, reading, listening and writing) in an International English Language Testing System (IELTS) test that has been undertaken in the three years immediately prior to lodging the visa application.
You have achieved a score of 'A' in each of the four test components of an Occupational English Test (OET) that has been undertaken in the three years immediately prior to lodging the visa application.
You have achieved the following minimum test scores in each of the four test components: 28 for listening, 29 for reading, 30 for writing and 26 for speaking, in a Test of English as a Foreign Language internet-based test (TOEFL iBT) test that has been undertaken in the three years immediately prior to lodging the visa application.
You have achieved a test score of at least 79 in each of the four test components (speaking, reading, listening and writing) in a Pearson Test of English (PTE) Academic that has been undertaken in the three years immediately prior to lodging the visa application.
You have achieved a test score of at least 200 in each of the four test components (speaking, reading, listening and writing) in a Cambridge English: Advanced (CAE) test that has been undertaken on or after 1 January 2015 and prior to lodging the visa application.
The Temporary Residence Transition stream is for subclass 457 visa holders who have worked with an Australian employer for at least the last 2 years in the nominated occupation and their employer wants to offer them a permanent position in the same occupation.
A visa permitting a person to remain temporarily in Australia.
An unlawful non-citizen is a national from another country who does not have the right to be in Australia.
Venture capital funding is monetary assistance that was provided by a venture capital firm, for the purposes of the early phase start-up of a business, product commercialisation, business development or business expansion.
Permission to travel to, to enter and/or to remain in Australia for a period of time or indefinitely.
If any members of your family unit who are included in your application and who are over the age of 18 have been assessed as not having functional English language skills, they will be required to pay a second installment (see form 990i Charges) which entitles them to English language tuition in Australia to achieve functional English. The full amount must
be paid before a visa can be granted to them.
To demonstrate vocational English, you must provide evidence of one of the following:
You hold a valid passport issued by the United Kingdom, the United States of America, Canada, New Zealand or the Republic of Ireland and you are a citizen of that country.
You have achieved a score of at least 5 in each of the four test components (speaking, reading, listening and writing) in an International English Language Testing System (IELTS) test that has been undertaken in the three years immediately prior to lodging the visa application.
You have achieved a score of at least 'B' in each of the four test components of an Occupational English Test (OET) that has been undertaken in the three years immediately prior to lodging the visa application.
You have achieved the following minimum test scores in each of the four test components: 4 for listening, 4 for reading, 14 for writing and 14 for speaking, in a Test of English as a Foreign Language internet-based test (TOEFL iBT) that has been undertaken in the three years immediately prior to lodging the visa application.
You have achieved a test score of at least 36 in each of the four test components (speaking, reading, listening and writing) in a Pearson Test of English (PTE) Academic that has been undertaken in the three years immediately prior to lodging the visa application.
You have achieved a test score of at least 154 in each of the four test components (speaking, reading, listening and writing) in a Cambridge English: Advanced (CAE) test that was undertaken on or after 1 January 2015 and prior to lodging the visa application.
