SUBCLASS 188

Business Innovation and Investment (Provisional) Visa

This is a temporary visa that lets people with business skills own and manage a business in Australia, conduct business and investment activity in Australia or undertake an entrepreneurial activity in Australia.

Basic requirements

The applicant must:
  • submit expression of interest (EOI) in SkillSelect
  • be nominated by a State or Territory government agency or the CEO of Austrade 
  • be invited to apply for the visa
The Subclass 188 visa has several streams:


Business Innovation stream


Purpose

For people with business skills to operate a new or existing business in Australia.


Stay

Up to 4 years and 3 months
Can be extended for another 2 years


Requirements

Applicants must:

  • have assets of at least AUD800,000
  • an ownership stake in one or more qualifying businesses with turnover of at least AUD500,000 for least 2 of the 4 fiscal years immediately before you are invited to apply
  • score at least 65 on the points test
  • be under the age of 55
  • have functional English


Investor stream

Purpose

For people who invest at least AUD1.5 million in an Australian State or Territory


Stay

Up to 4 years and 3 months

Requirements

Applicants must:

  • have managed a qualifying business or investments to the value of at least AUD1.5 million for at least 1 of the 5 fiscal years immediately before you are invited to apply
  • have assets of at least AUD2.25 million
  • make an investment of AUD1.5 million in an Australian State or Territory
  • intend to live in a specific State or Territory
  • score at least 65 on the points test
  • be under the age of 55
  • have functional English


Significant Investor stream


Purpose

For people who invest at least AUD5 million in Australian investments


Stay

Up to 4 years and 3 months
Can be extended for another 2 years


Requirements

Applicants must: 

  • invest at least AUD5 million in venture capital funds and approved managed funds when invited
  • have a genuine intention to hold that investment for at least for 4 years
  • have functional English



Premium Investor stream

Purpose

For people who are nominated by Austrade and invest at least AUD15 million in Australian investments and/or philanthropic contributions


Stay

Up to 4 years and 3 months

Requirements

Applicants must: 

  • invest at least AUD15 million in eligible investments and/or philanthropic donations endorsed by a state or territory government
  • have a genuine intention to continue your investment activity in Australia after your visa ends
  • have net assets of at least AUD15 million
  • have functional English
Entrepreneur stream

Purpose

For people who carry out entrepreneurial activities in Australia


Stay

Up to 4 years and 3 months


Requirements

Applicants must: 

  • have a funding agreement of at least AUD200,000 to carry out eligible entrepreneurial activities
  • be under the age of 55
  • have competent English
Potential pathways
Getting this visa is the first step towards a permanent Business Innovation and Investment visa (Subclass 888). If eligible, people who hold a permanent Subclass 188 via can go on to apply for Australian citizenship.

SUBCLASS 132

Business Talent (Permanent) Visa

This permanent visa lets experienced business owners or entrepreneurs establish a new or develop an existing business in Australia. Visa holders can also sponsor family members to come to Australia.

Basic requirements

The applicant must:
  • be nominated by an Australian state or territory government agency
  • be invited to apply for the visa
  • have the required funding or assets
The Subclass 132 visa has two different streams:
Significant Business History stream

Purpose

For experienced business owners, to operate a new or existing business in Australia.

Stay

Permanent

Requirement

Applicant must:

  • have assets of AUD1.5 million (lawfully acquired) and annual business turnover of AUD3 million
  • a total net assets of at least AUD400,000 as the ownership interest in one or more qualifying businesses for least 2 of the 4 fiscal years immediately before you are invited to apply
  • be nominated by an Australian state or territory government
  • be invited to apply for the visa
Venture Capital Entrepreneur stream

Purpose

For people who have sourced venture capital funding from a member of the Australian Investment Council (AIC)

Stay

Permanent

Requirement

Applicants must:

  • have funding of at least AUD1 million from an Australian venture capital firm.
  • be nominated by an Australian state or territory government
  • be invited to apply for the visa
Potential pathways
If eligible, 132 visa holders can go on to apply for Australian citizenship.
